Believe you are turning on during clear condition, of coz it an offense.
Anyway foglight is not meant for clear night, can be use on heavy downpour and hazy weather.
In heavy downpour, do you think the TP will be so on and issue you summons under the heavy rain and getting themselves all wet? :)
